Acceptance of Terms

Welcome to QRCode.ing. These Terms of Service (“Terms”, “Agreement”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and QRCode.ing (“Company”, “we”, “us”, or “our”) governing your access to and use of our website, applications, and services (collectively, the “Service”).

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

Definitions

For the purposes of these Terms, the following definitions apply:

“Service”
The QRCode.ing platform, including our website, web applications, APIs, QR code generation tools, analytics features, linkpages, and all related services.
“Account”
A registered user account that enables access to the Service, including personal accounts and team workspaces.
“Content”
Any data, text, graphics, images, QR codes, linkpages, files, or other materials uploaded, submitted, or created through the Service.
“QR Code”
A machine-readable optical label containing information about the item to which it is attached, generated through our Service.
“Linkpage”
A customizable landing page created through the Service that can be linked to QR codes.
“Subscription”
A recurring payment plan that provides access to premium features and enhanced usage limits.

Eligibility

To use the Service, you must meet the following eligibility requirements:

  • Age Requirement: You must be at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is greater.
  • Legal Capacity: You must have the legal capacity to enter into a binding contract and not be barred from using the Service under applicable law.
  • Authority: If you are using the Service on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.
  • Compliance: You must comply with all applicable local, state, national, and international laws and regulations.

Account Registration

Account Creation

To access certain features of the Service, you must create an Account. When registering, you agree to provide accurate, current, and complete information and to update such information as necessary to maintain its accuracy.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your Account. You agree to:

  • Create a strong, unique password for your Account
  • Notify us immediately of any unauthorized access or security breach
  • Not share your account credentials with any third party
  • Log out from your Account at the end of each session on shared devices

Team Accounts

Team accounts allow multiple users to collaborate within a shared workspace. The account owner is responsible for managing team member access and permissions, and for ensuring all team members comply with these Terms.

Service Description

QRCode.ing provides a comprehensive platform for:

  • Dynamic QR Code Generation: Create customizable QR codes that can be updated without reprinting, including animated QR codes with GIF backgrounds.
  • Multiple Content Types: Support for URLs, text, WiFi credentials, contact cards (vCard), email, SMS, files, social links, linkpages, and app store links.
  • Linkpages: Customizable landing pages with multiple content blocks, themes, and analytics.
  • Analytics: Real-time scan tracking including geographic location, device information, and temporal data.
  • Smart Routing: Conditional redirects based on device type, location, or other parameters (available on select plans).
  • A/B Testing: Test multiple destinations to optimize conversion (available on select plans).
  • Custom Domains: Use your own domain for short-links (available on select plans).
  • API Access: Programmatic access to create and manage QR codes (available on select plans).

Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. The following uses are strictly prohibited:

Prohibited Content

  • Content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Content that infringes on intellectual property rights of others, including copyrights, trademarks, or patents
  • Malware, viruses, or other malicious code designed to harm or compromise systems
  • Phishing schemes or content designed to fraudulently obtain personal information
  • Adult or sexually explicit content without appropriate age-gating measures
  • Content promoting violence, terrorism, or illegal activities

Prohibited Activities

  • Attempting to gain unauthorized access to the Service or related systems
  • Using the Service to send spam or unsolicited communications
  • Interfering with or disrupting the Service or servers
  • Bypassing or circumventing usage limits or access controls
  • Scraping, crawling, or using automated means to access the Service without authorization
  • Reselling or redistributing the Service without our prior written consent
  • Using the Service in a manner that could damage our reputation or goodwill

We reserve the right to investigate and take appropriate legal action against anyone who violates this policy, including removing content, suspending or terminating accounts, and reporting violations to law enforcement.

User Content & License

Ownership

You retain all ownership rights in the Content you create, upload, or submit through the Service. We do not claim ownership of your Content.

License Grant

By submitting Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and distribute your Content solely for the purpose of operating and providing the Service. This license continues until you delete your Content or terminate your Account.

Content Responsibility

You are solely responsible for your Content and the consequences of publishing it. You represent and warrant that:

  • You own or have the necessary rights to use and authorize us to use your Content
  • Your Content does not violate any applicable laws or regulations
  • Your Content does not infringe the rights of any third party

Content Moderation

We reserve the right, but have no obligation, to monitor, review, or remove Content at our sole discretion. We may remove or disable access to any Content that violates these Terms or that we believe may be harmful, illegal, or inappropriate.

Intellectual Property

Our Intellectual Property

The Service, including its original content, features, functionality, and underlying technology, is owned by QRCode.ing and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks, logos, and service marks may not be used without our prior written permission.

Feedback

If you provide us with feedback, suggestions, or ideas regarding the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use such feedback for any purpose without compensation or attribution.

DMCA & Copyright Infringement

We respect the intellectual property rights of others. If you believe that your copyrighted work has been used in a way that constitutes copyright infringement, please contact us at contact@qrcode.ing with the following information:

  • A description of the copyrighted work claimed to be infringed
  • The URL or location of the allegedly infringing material
  • Your contact information (name, address, phone, email)
  • A statement that you have a good faith belief that the use is unauthorized
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

Billing & Subscriptions

Free and Paid Plans

The Service offers both free and paid subscription plans. Free plans are subject to usage limitations. Paid subscriptions provide enhanced features and increased usage limits as described on our pricing page.

Billing Cycle

Paid subscriptions are billed in advance on a monthly or annual basis, depending on the plan selected. Your subscription will automatically renew at the end of each billing cycle unless cancelled.

Payment

You agree to provide accurate billing information and authorize us to charge your designated payment method for all applicable fees. You are responsible for any taxes associated with your subscription.

Price Changes

We reserve the right to modify our pricing at any time. Price changes will be communicated in advance and will take effect at the start of your next billing cycle. Continued use of the Service after a price change constitutes acceptance of the new pricing.

Refunds

Unless required by applicable law, fees are non-refundable. If you cancel your subscription, you will retain access to paid features until the end of your current billing period.

Plan Downgrades

If you downgrade to a lower plan, features and usage limits will be adjusted accordingly at the start of your next billing cycle. Content exceeding the new plan's limits may be deactivated or made inaccessible.

Termination

Termination by You

You may terminate your Account at any time through your account settings or by contacting us. Upon termination, your right to use the Service will immediately cease.

Termination by Us

We may suspend or terminate your Account if:

  • You breach any provision of these Terms
  • We are required to do so by law or legal process
  • Your conduct may harm us, our users, or third parties
  • Your Account has been inactive for an extended period
  • We discontinue the Service (with reasonable notice)

Effect of Termination

Upon termination:

  • Your license to use the Service is immediately revoked
  • We may delete your Account and Content (after a reasonable retention period)
  • QR codes linked to your Account may cease to function
  • Provisions of these Terms that should survive termination will remain in effect

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • The quality of the Service will meet your expectations
  • Any errors in the Service will be corrected

You understand and agree that you use the Service at your own risk and discretion. We are not responsible for any third-party content or destinations linked through QR codes created using the Service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QRCODE.ING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for all claims arising from or relating to these Terms or the Service shall not exceed the greater of: (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless QRCode.ing, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any Content you create, submit, or transmit through the Service
  • Your violation of any applicable laws or regulations

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation. If informal resolution is unsuccessful, both parties agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the “Last Updated” date at the top of these Terms
  • Notify you by email or through the Service (for material changes)
  • Provide you with a reasonable opportunity to review the changes before they take effect

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and terminate your Account.
